Lavinia had stopped at a gas station April 21 and chose to drizzle the Doritos she bought with the gas station's nacho cheese sauce.
The California Department of Public Health, in collaboration with Sacramento County Public Health (SCPH) and neighboring county public health departments, is continuing to investigate an outbreak of foodborne botulism.
On April 21, Kelly was heading home when she made a decision to stop at the Valley Oak Food and Fuel to grab a quick snack. Lavinia grabbed a bag of Doritos and chose to make them cheesier by pouring some of the gas station's nacho cheese over them.
Within hours, the usually upbeat mother of three felt tired, he said.
The next day, the mother-of-three went to a local hospital to be treated for double vision, according to the Sacramento Bee.
Lavinia Kelly is so sick that she can't speak or breathe on her own and spent her 33rd birthday this week in an intensive care unit, the Sacramento Bee reported.
"Only human mistakes create the environment for botulinum toxin to form", her attorney told the Bee. Really? How does that happen?
Investigations are ongoing as to what caused the illness, but officials are now putting it down to a batch of nacho cheese. Symptoms include weakness, vision impairment, fatigue and speech trouble.
One of the victims has filed a lawsuit against the gas station. People can contract the serious illness through home-canned foods, improperly commercially canned foods, cheese sauce, and foods held in warmers for extended periods of time, according to FoodSafety.gov.
Bruce Clark, the family's lawyer, would not say how much money they are suing for, but he says similar cases in the past involved millions of dollars. Clark stated that "human mistakes" are behind the creation of a ideal environment for the formation of "botulinum toxin".
In the case of the gas station nacho cheese, the main source of the contamination is still unclear.
Outside, Valley Oak Food and Fuel is open for business, but inside, health officials have stopped the sale of food items and roped off a part of the store. "That's an essential question". Clark did say, "They're acquiring astounding medical bills".
