Counsel for Pakistan before the International Court of International (ICJ) Khawar Qureshi said on Friday that the court had just issued an interim order so that the hearing could be completed.
The Indian legal expert said the judge could have recused himself from the panel, which would have weakened any move by Pakistan to appoint an ad hoc judge. "Who gave the opinion to deny consular access to Jadhav in the first place?" she asked.
"India misled the court and we have shown that", he said, urging the media to show restraint and not spread false news.
"If the Army chief said that he provided the lawyer for the Jadhav case and then any criticism directed at him is baseless", Geo News quoted Sadiq, as saying. Salve added. Buoyed after the ICJ verdict, Salve said that it is clear that we will get a fair access to him and once that is done we will provide all necessary legal help to him.
Islamabad could insist on cooperation from India on the investigation into Jadhav's activities, he said.
Pakistani analysts, who were earlier confident that the ICJ does not have jurisdiction to stay Jadhav's execution, observed after the verdict that the jurisdiction argument was "weak" and "damaging", reported Dawn. A senior official told The Express Tribune that India had been successful in managing the ICJ's registrar office, which has vast powers to fix cases before the court.
Abraham added that under the Vienna Convention, India should have received consular access to seek justice for the former Indian Naval officer. "We were very surprised how swiftly Jadhav's case was fixed before the ICJ", he said. He said that the provision of consular services in cases of terrorism and spying were not mandatory. However, Haresh Salve, counsel for India, contended that the agreement was not registered with the United Nations. An ad hoc judge can also be chosen if the panel includes "no judge of the nationality of the parties", according to the article. According to CNN-News18, an application has been moved to the ICJ by the Pakistani side, where they want to challenge the jurisdiction of the ICJ itself.
Pakistan maintained in the court on May 15 that it did not reserve the jurisdiction to hear the case as it was a matter concerning Pakistan's national stability. "We lost important cases at the worldwide forum in the last couple of years".
National Assembly Speaker Ayaz Sadiq on Friday said that Indian spy Kulbushan Jadhav's issue should not be politicised.
