On May 9, the top court had ruled Mallya guilty of contempt after he failed to declare details of his assets, and thus, upheld the plea by a consortium of banks that sought the initiation of recovery proceedings to the tune of Rs 9,000 crores. The offence of contempt of court entails a maximum imprisonment of up to six months or a fine of upto Rs 2,000 or both.
The case was being upheld on a plea made by a consortium of lender banks led by the State Bank of India (SBI) after it had contested that Mallya had allegedly transferred at least Dollars 40 million received from Diageo to his children in violation of judicial orders. India had given a formal extradition request for Mallya as per the extradition treaty between India and United Kingdom through a note verbale, a diplomatic communication. The banks have alleged that Mallya had concealed facts and diverted the money to his son Siddharth Mallya and daughters Leanna Mallya and Tanya Mallya in "flagrant violation" of the orders passed by the Karnataka High Court.
The ED has also said that these shell companies had no actual activities and was fully controlled by Mallya with former employees of UB group being its directors.
