After dentist couple Nupur and Rajesh Talwar were found innocent of murdering their only child Aarushi and their domestic help, Hemraj, the man who headed the CBI for a key part of the investigation told NDTV, "There were loopholes in our investigation". "We always knew they were not guilty", Aarushi's maternal grandfather B.G. Chitnis said.
The CBI court while pronouncing its verdict had said that there is no direct evidence in the Aarushi Talwar murder case but it is clear that the prosecution has placed a clinching wealth of circumstances from which the guilt of both the accused has been made out to the extent human instruments can apprehend'.
Aarushi was found murdered inside her bedroom on May 16, 2008.
However, Hemraj's body was found found on the terrace of Talwar's residence the next day. The police was suspecting that the househelp could be the murderer who was missing from the house.
However, the court chose to hear the appeals afresh due to contradictions in some submissions made by the CBI.
Defence in High Court: There was a friendly entry. The High Court had also chose to hear the appeals afresh due to contradictions in some submissions made by the Central Bureau of Investigation (CBI) and had resumed the hearing in August.
An Indian court on Thursday overturned the conviction of a dentist couple for the murder of their teenage daughter and the family servant for lack of material evidence, their lawyer said. Vishnu Sharma, Talwar's previous help and Kishan their compounder were also arrested on suspicion of murder, but the court released them after a lie-detection test. They (the Talwar couple) have really suffered. It initially absolved the parents of conspiracy and murder but later held them responsible.
CBI submitted a closure report on the case in December, 2010 on the basis of "insufficient evidence". They were also convicted for destruction of evidence.
On November 26, 2013, both were sentenced to life imprisonment by the CBI court.
"One of the big loopholes in the investigation was that Hemraj's blood was never found in the room", said AP Singh.
