The bench headed by Chief Justice Ranjan Gogoi held that at the present stage, what is necessary is an inquiry to find out whether there is a prima facie case. "Honourable Supreme Court should immediately intervene".
Here comes the catch. The BJP, in turn, rubbished his claims and found some relief in the Supreme Court's verdict that did not overturn the government's decision entirely. Dramatic visuals, which were widely shared on social media, showed Verma's security officers hauling them into his residence before they were handed over to police.
All decisions taken by Rao shall be placed before the apex court in a sealed cover.
He said after the orders divesting Verma of his duties were passed, on October 23 another order was issued appointing Rao to perform the duties of the CBI director.
Senior advocate Fali S. Nariman, appearing for Verma, cited a 1997 judgement (Vineet Narain vs Union of India) that laid down guidelines on the functioning of the CVC and the CBI.
The CVC took an overnight decision to divest me completely of the CBI director's role. It was absolutely essential to restore the agency's institutional integrity and credibility, he said.
Taking to the streets, the Congress on Friday took out nationwide protest marches to CBI offices accusing the government of trying to "cage the CBI", as the party president Rahul Gandhi, along with several others, courted arrest and alleged "every institution was being ruined" in the country. The Opposition led by Congress has said that the Modi government removed CBI director Alok Verma because he was raising questions over the irregularities in Rafale fighter jet deal.
"The prime minister acted against the CBI director as a result of panic and as a result of fear because he has helped Mr Ambani", Gandhi said as he left the police station.
The leader of the Congress party in the Lok Sabha said that it was apt that Tharoor's book will be launched by former Prime Minister Manmohan Singh, "who worked silently to lift the greatest number of people from poverty, led India on the road of high economic growth, ensured our nation took her rightful place in the world forums and worked for peace within and at the borders". It was irrational, illegal, unconstitutional and criminal, he said.
Interestingly, Kharge had lodged his dissent over the appointment of Verma as CBI Director past year, stating that he had no experience in the CBI and anti-corruption cases.
