"We are obviously disappointed with the decision of the AG (Attorney-General) not to withdraw the charge in Doan's case", defense attorney Hisyam Teh Poh Teik told the Shah Alam High Court near Kuala Lumpur.
Doan and Siti Aisyah, as well as four others still at large, were accused of Jong-nam's murder at the departure hall of the KL International Airport 2 (klia2) on Feb 13, 2017.
The other, Indonesian national Siti Aisyah, was freed on Monday in a surprise ruling. He said prosecutors were being unfair to Huong as her case was similar to Aisyah.
He also sought a deferment of the trial, saying Huong has been unwell since Aisyah's release and is not in a position to testify.
While the defense phase of her trial was set to begin Monday, it was postponed until today in light of the abrupt release of her co-defendant, and now again until April 1 in consideration of her health, Bloomberg reported.
Defence lawyers have maintained the women were pawns in an assassination orchestrated by North Korean agents. The global police organization Interpol has issued red notices asking governments around the world to send them back to face trial.
In late March 2017, the body of Kim, who lived in Macau, was eventually returned to North Korea despite weeks of diplomatic feuding between Kuala Lumpur and Pyongyang over his killing. Indonesia's Law and Human Rights Ministry sent a formal letter to Malaysian Attorney General Tommy Thomas, to which he responded on Friday last week.
The decision to move forward with Huong's case was slammed by both her lawyer and Vietnam's ambassador, who had hoped she would be given the same leniency as Aisyah. "I think she must given the opportunity to be treated by a doctor". They have said they thought they were taking part in a harmless prank for a TV show. There was security camera video of Huong with Kim.
The prosecutor did not give reason why charges were not being dropped for Ms Huong, 30, who is now the sole defendant on trial for Mr Kim's murder and could face death by hanging if convicted.
"You can look at her, she was crying this morning, she was depressed, and she didn't sleep, perhaps did not eat well as well", he said.
In Huong's village in Vietnam, her family was crestfallen.
